RETAINER AGREEMENT

1. Deposition in Doctor’s office:

Start time: The starting time is the time that the appointment for the deposition was made. Should there be a delay in starting time, the parties still will compensate the physician from the original start time. Please arrange for all the parties, including the court reporter, to be on time.

End time: The parties should plan to finish the deposition in the expected time frame. Should this not be the case, the parties may mutually agree upon continuation. Please estimate the time required for the deposition. This would be necessary to avoid any conflicts with regard to the daily flow of patients in physician’s practice.

Compensation:

A minimum two-hour payment is requested to be paid in advance, preferably by 5pm the day before deposition, but no later than the start of the deposition.

If the deposition goes beyond the anticipated time frame, the deposing attorney will pay for the additional fees at the end of the deposition. The deposing attorney may provide this compensation by credit card, personal check or company’s check. Please come prepared. Should for any reason the deposing attorney fail to do so, the physician will keep the right to read this matter to the recorder that he will be compensated fully for his services within two working days.
Increments: The fee for the deposition/expert testimony in the office setting is $450/hour with a minimum of 2 hours. Any increments afterwards will be at $225/each half hour.

Cancellation policy: There will be no cancellation fee for canceling the deposition five working days prior to the deposition. For any later date a cancellation fee applies. The fee will be in increments of $180.00/day (based on 20% of $900.00).

2. Court Appearance and Expert Witness Testimony:

Cancellation policy: There will be no cancellation fee for canceling Dr. Rahbar’s court appearance 5 working days prior to my court date. Otherwise a fee will be applied. This fee will be in increments of $400.00/day (20% 0f $2000.00) with a maximum of $2000.00. Cancellation fees are due within two working days following the notification of the physician.

Physician notification: Please plan to notify me directly regarding any cancellation of my court date. If I am not in my office request my staff to page me. If for any reason I am not available, you may convey message to my assistant. If our lines are forwarded to the exchange, please page me like a "patient with urgent matter". Please do not simply leave a message on the non-emergency voice mail.

3. Travelling Expenses: There is no fee for travelling up to 5 miles radius from Dr. Rahbar’s office. Beyond this a fee may apply, which will be based on the actual costs and travelling time.
